2.1 Medical and Physical Fitness

  • Many of our physical tours, hikes, and events take place in rugged, natural outdoor environments.
  • By booking an activity, you warrant that you (and any minors under your care) are in sufficient physical health and condition to participate.
  • You are solely responsible for disclosing any severe allergies (e.g., bee stings), medical conditions, or physical limitations to your guide prior to the commencement of the activity.

2.2 Right of Admission Reserved

We reserve the right to refuse participation to any individual whose conduct, sobriety, or physical preparedness (e.g., lack of appropriate footwear or water) compromises the safety or preservation of the tour group, the guide, or the natural environment.

3. Indemnity and Limitation of Liability

Nature reserves and wild fynbos habitats carry inherent risks, including but not limited to uneven terrain, unpredictable weather, and wild flora or fauna.

IMPORTANT LEGAL NOTICE: VOLUNTARY ASSUMPTION OF RISK To the maximum extent permitted under South African law, Fynbos & Beyond, its directors, employees, volunteers, guides, and agents shall not be held liable for any direct, indirect, incidental, special, or consequential damages, losses, injuries, or illnesses resulting from:

  1. Your access to or use of this Website.
  2. Your physical participation in any guided tours, walks, or community events.
  3. Any loss or damage to personal property while participating in an event.

4. Donations, Online Shop, and Payments

4.1 Voluntary Donations

Financial contributions made to Fynbos & Beyond are voluntary gifts used to fund conservation and community projects. All donations are non-refundable, except under the circumstances outlined in our Refund and Returns Policy.

4.2 Online Transactions and Security

  • All payments made through the Website are processed via secure, PCI-compliant third-party payment gateways (e.g., PayStack, PayFast, Yoco, Ozow). Fynbos & Beyond does not store your full credit card or banking details.
  • We reserve the right to refuse or cancel any order or booking request due to suspected fraud, incorrect pricing, or inventory errors.
